To be licensed or unlicensed, this is the question There's a lot of talk at the moment about Representatives no longer requiring licences as "they're being cancelled". This is utter rubbish! Despite what the Better Regulations Office did with their Review, (which by the way, is at a complete stand still and very much looking like it will be completely overturned), the fact remains that licensing IS STILL required - right NOW. This is clearly stipulated by NSW Industrial Relations! Pity help any person that believes they no longer need a licence and don't renew, or completely ignore NSW IR's Legislation. It is never a good business choice to accept work from an unlicensed representative - Never! You can read our open letter here, to venues regarding licensing; please feel free to forward it to others. The more people that know about the potential damage of unlicensed operators, the better!
NEWS FLASH!! Rumour has it that there's soon to be a targeted campaign of the Entertainment Industry! It looks like the NSW Government is preparing themselves to catch as many illegally trading representatives as possible (agents, managers and venue consultants), that are acting in a representative/s capacity without the appropriate licence. As you would be aware, this is a breach of the Entertainment Industry Act 1989 which stipulates a maximum penalty (fine) of 50 points for the offence. Each point is $110; that's $5,500. It wouldn't be a surprise if they did something similar to WorkCover and the ATO in the past and went back through years of transactions and found additional breaches to apply fine/s to as well. If you come across a representative that isn't licensed, let them know about the campaign and encourage them to obtain the necessary licence/s.
